These Terms and Conditions of Use (the "Terms of Service") apply to the Club Penguin Journey website located at www.cpjourney.net, and all associated sites linked to www.cpjourney.net by Club Penguin Journey, its subsidiaries and affiliates, including Club Penguin Journey sites around the world (collectively, the "The Site"). The Site is the property of Club Penguin Journey and its licensors. BY USING THE SITE, YOU AGREE TO THESE TERMS OF USE; IF YOU DO NOT AGREE, DO NOT USE THE SITE.

CPJourney.net Worldwide Services and designated subsidiaries (“Club Penguin Journey”, “we,” or “us”) offers the Club Penguin Journey website (www.cpjourney.net) and its related platform (collectively, “Platform”) and various other features and services, including websites, applications, forums, content, functionality, products, and services (together with the Platform, “Services”) to allow users (“Users,” “your,” or “you”) to play, create, and connect.

Club Penguin Journey reserves the right, at its sole discretion, to change, modify, add or remove portions of these Terms of Use, at any time. It is your responsibility to check these Terms of Use periodically for changes. Your continued use of the Site following the posting of changes will mean that you accept and agree to the changes. As long as you comply with these Terms of Use, Club Penguin Journey grants you a personal, non-exclusive, non-transferable, limited privilege to enter and use the Site.

BY PERMITTING A MINOR TO USE THE SERVICES, A MINOR’S PARENT OR GUARDIAN BECOMES SUBJECT TO THE CLUB PENGUIN JOURNEY TERMS AND AGREES TO BE RESPONSIBLE FOR ALL OF THE MINOR’S ACTIVITIES ON THE SERVICES, INCLUDING THE PURCHASE OF ANY VIRTUAL CONTENT.

You agree that your account is personal to you and you may not transfer, sell, or gift your account or its contents. We reserve the right to terminate accounts that we believe have been transferred without notice.

Copyright Waiver

Submitting artwork, music, or any copyrightable material for use in our game or website constitutes a waiver of your rights to reclaim or request removal of your submission, unless stated otherwise prior to submission.

Content Standards

All content must be appropriate and respectful. Content deemed defamatory, abusive, harassing, threatening, violent, vulgar, obscene, sexually explicit, or otherwise offensive is strictly prohibited.

Cheating and Unauthorized Access

Attempting to gain an unfair advantage, cheat, hack, or send unauthorized packets to our servers is forbidden and may lead to account termination.

Toxicity/Instigation

Threats of Violence

Threatening, provoking, or soliciting violence against others is strictly prohibited. Accounts involved in such behavior will face immediate disciplinary action.

Substance Discussions

Discussions about alcohol, drugs, or any illegal substances are not permitted. This includes attempts to disguise such discussions through slang or misspellings.

Sensitive Topics

To ensure a safe and welcoming environment, discussions on religious, political, or other sensitive topics are discouraged and may be subject to moderation.

Harassment and Abuse

Harassment or abuse of any kind will not be tolerated. Engaging in such behavior will result in immediate action against the perpetrator's account.

Sexually Explicit Content

Sharing or promoting sexually explicit content is strictly forbidden and will lead to account termination.

Personal Information

Asking for or sharing personal information, such as real names, addresses, or contact details, is prohibited to protect user privacy.

Discriminatory Language

Ban Evasion

Account Sharing

Advertisements and Spam

Discussion of Other Servers

Discussing or promoting other Club Penguin Private Servers (CPPS) is not allowed.

Bypassing the Filter

Attempting to bypass any content filters we have in place is not acceptable.

Language and Conduct

Language or behavior falling under any prohibited category or perceived as harmful to the integrity of Club Penguin Journey or the community will be subject to prompt disciplinary action without notice.

Usernames

By registering a username, you acknowledge that not all usernames will be approved for use in-game. Inappropriate usernames may result in a request for change or account ban.

Changes and Amendments

We reserve the right to modify these Terms of Service at any time. Your continued use of Club Penguin Journey signifies your acceptance of these changes.

Content

Unless expressly stated otherwise in these Terms of Use, no part of the Site or Content may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, or distributed in any way (including "mirroring") to any other computer, server, Web site, or other medium for publication or distribution, or for any commercial enterprise, without Club Penguin Journey’s express prior written consent.

Your Use of the Site

You may not use any "deep-link," "page-scrape," "robot," "spider," or other automatic device, program, algorithm, or methodology, or any similar or equivalent manual process, to access, acquire, copy, or monitor any portion of the Site or any Content, or to reproduce or circumvent the navigational structure or presentation of the Site or any Content, or to obtain or attempt to obtain any materials, documents, or information through any means not purposefully made available. Club Penguin Journey maintains the right to prohibit such behavior.

You may not use hacking, password "mining," or any other illicit methods to gain unauthorized access to any section or feature of the Site, or any other systems or networks connected to the Site or any Club Penguin Journey server, or to any of the services offered on or through the Site.

Accounts, Passwords, and Security

Certain features or services available on or through the Site may necessitate the creation of an account (including setting up a Club Penguin Journey ID and password). You are fully responsible for maintaining the security of your account's information, including your password, as well as any and all activity that occurs under your account as a consequence of your failure to keep this information safe and secret. You undertake to notify Club Penguin Journey promptly of any unauthorized use of your account or password, as well as any other security violation. You may be held accountable for Club Penguin Journey’s or any other user's or visitor's losses suffered as a consequence of someone else accessing your Club Penguin Journey ID, password, or account as a result of your actions.

Termination

Club Penguin Journey reserves the right to suspend or terminate your account if you violate any of these Terms of Service or engage in any prohibited behavior.

Limitation of Liability

TO THE EXTENT REQUIRED BY APPLICABLE LAW, WE DO NOT LIMIT IN ANY WAY OUR LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE OR FOR OUR FRAUDULENT MISREPRESENTATION OR CONCEALMENT OR FOR ANY OTHER LIABILITY WHICH CANNOT BE EXCLUDED OR LIMITED BY APPLICABLE LAWS. UNDER NO CIRCUMSTANCES, INCLUDING NEGLIGENCE, SHALL CLUB PENGUIN JOURNEY, OUR LICENSORS, OR LICENSEES BE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE USE OF THE SITE OR SERVICES.

Indemnification

You agree to defend, indemnify, and hold harmless Club Penguin Journey, its affiliates, and their respective officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) resulting from your violation of these Terms of Service or your use of the Site or Services.

These Terms of Service shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any conflict of law principles.
